Section 8.46

Subd. 1. RESTRICTION ON MINORS.

 

It shall be unlawful for any minor under the age of 16 years to be upon the public streets, alleys, parks, playgrounds, public places and public buildings, places of entertainment and amusement, vacant lots, and other unsupervised places in the City between the hours of ten o'clock p.m. and five o'clock a.m. the following day. It shall be unlawful for any minor who is 16 years of age to be upon the public streets, alleys, parks, playgrounds, public places and public buildings, places of entertainment and amusement, vacant lots, and other unsupervised places in the City between the hours of twelve o'clock midnight and five o'clock a.m. the following day provided, however, that the provisions of the Section do not apply to a minor accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, to a minor who is upon an emergency errand or other legitimate business directed by his or her parent, guardian, or an adult person having the care and custody of the minor, or where the presence of said minor in said place or places is connected with and required by some legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor, or where the presence of said minor in said place or places is connected with and required by some legitimate business, trade, profession or occupation in which said minor is permitted by law to be engaged.

 


Subd. 2. DUTIES OF PARENT OR GUARDIANS.

 

It shall be unlawful for the parent, guardian, or other adult person having charge of a minor to permit such minor to be upon the public streets, alleys, parks, playgrounds or other public grounds, places and public buildings, places of entertainment and amusement, vacant lots and other unsupervised places in the City during the hours prohibited by this Section; provided, however, that the provisions of this Section do not apply when the minor is accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor, or where the presence of said minor, in said place is connected with and required by some legitimate business, trade, profession, or occupation in which said minor is permitted by law to be engaged.

 


Subd. 3. MINORS IN AMUSEMENT PLACES.

 

No person, operating or in charge of any place of amusement, entertainment or refreshment shall permit any minor to remain in such place during the hours prohibited by this Section; provided, however, that the provisions of this Section shall not apply when such minor is accompanied by his or her parent, guardian or other adult person having the care and custody of the minor.

 


Subd. 4. SCHOOL NIGHTS AND YOUTH NIGHTS.

 

The Mayor, upon the request of the superintendent of any public schools in the City, may designate certain nights during the school year as "School Nights" at such times as said schools shall be engaged in athletic, musical, dramatic or social activities for the benefit or entertainment of its students. The provisions of subdivisions 1 and 2 shall not apply to any student or to his parents, guardian or other adult person having charge of such minor who is lawfully going to, attending or returning from any such school function on any designated "School Night" or "Youth Night".

 


Subd. 5. PLAYGROUND CURFEW.

 

All public playgrounds, and skating rinks in the City shall be closed by the Recreation Department at the hour of ten o'clock each evening. It is unlawful for any person or group of persons to occupy such playgrounds or skating rinks after the hour of ten o'clock p.m. without written permission of an authorized City official.
