Section 8.44
Subd. 1. It shall be unlawful for any person or persons to use, consume, mix or prepare liquor for consumption in any place of public accommodation without a permit issued by City Council.
Subd. 2. It shall be unlawful for any person or persons in charge of any place of public accommodation to allow any person or persons to use, consume, tax or prepare or have in his possession any intoxicating liquor without a permit issued by City Council.
Subd. 3. It shall be unlawful for any proprietor or employee in charge of any place of public accommodation in the City of Tracy to allot any person or persons who are intoxicated to loiter or remain in his place of business.
Subd. 4. It shall be unlawful for any proprietor or employee in charge of any place of public accommodation to allow or permit any person or persons to open, uncork or unseal any package, container or receptacle holding intoxicating liquor in such place.
Subd. 5. It shall be unlawful for any proprietor or employee in charge of any public place, or place of business to allow or permit any person or persons to open, uncork or unseal any package, container or receptacle holding intoxicating liquor in such place.
Subd. 6.
A. The terms "intoxicating liquor" and "liquor" whenever used in this Section shall mean and include ethyl alcohol, distilled, fermented, spirituous, vinous and malt beverages containing more than 3.2 per cent of alcohol of weight.
B. The term "package" or "original package" shall mean and include any container or receptacle holding liquor, which container or receptacle is corked or sealed.
C. The term "Place of public accommodation" means facilities either publicly or privately owned that are used by the public at large.
Subd. 6. Any person violating any provision of this Section shall be guilty of a misdemeanor, upon conviction thereof.
