SECTION 7.10 PARKING AND TRAFFIC CODE.                     

 

Subd 1. PARKING.

 

 

  1. Manner of Parking. All vehicles shall be parked with the right hand side

    parallel to the curb, and not more than one foot from the curb, leaving at least 4 feet between parked vehicles, except where marks or signs on the streets indicate that cars shall be parked at an angle.

     

  2. Parking on Boulevard Prohibited. No vehicles shall be parked on any

    boulevard adjacent to any public street.

     

  3. Double Parking. Except that commercial vehicles may double park for the

    length of time necessary to load or unload when calling for or delivering parcels or merchandise and access to the curb is blocked, no vehicle shall be double parked in any street.

     

  4. Time Limitation for Trucks. No trucks with a capacity of over 2 tons shall be

    parked on any street for more than 90 minutes, or for the time necessary to load or unload such truck.

     

  5. Parking on Private Property. No vehicle shall be parked or left standing upon

    the private property of any person without his consent.

     

  6. 24 Hour Parking Limit. No vehicle shall be parked on any of the streets of the

    City of Tracy for a period longer than twenty-four consecutive hours.

     

  7. Impeding Snow Removal Operations. No motor vehicle shall be parked on any

    street or alley in a manner that would impede the removal of snow from such street or alley. A motor vehicle owner or operator whose motor vehicle is parked on a street or alley shall ensure that such vehicle is removed from said street or alley before snow removal operations commence.

     

  8. Removal and Impounding of Vehicles. Any officer of the police department

    may remove, cause to be removed, or require the owner or driver of a vehicle to move, any vehicles parking in the following manner:

     

     

  1.               A.  Any vehicle found to be in violation of Subd. 1-D and 1-H winter parking and snowfall restrictions.

     

  2.                B.  Any vehicle which is parked in such a manner as to create a significant public safety hazard.

     

  3.                C.  Any vehicle parked on private property without the consent of the property owner.

                   D.  Any vehicle parked in violation of Subd. 1-G, 24 Hour Parking Limit,after a good faith attempt to give notice to the last known registered owner of the vehicle, either by mail, phone, or verbally.

  4.                 E.  MN Statutes governing abandoned motor vehicles and/or reclaiming motor vehicles shall apply to all vehicles impounded by or for the City.  The owner or driver of the vehicle shall be responsible for all towing and impound fees, prior to reclaiming the vehicle.

                    I. Prosecution for Violation. The removal of a vehicle which is parked in violation of Section 7, either by a police officer or under the direction of a police officer, shall not preclude a prosecution for violation of any provision of this section.

                   J.  Vehicular Parking or Traffic Temporarily prohibited. The Director of Public Works or the Chief of Police may temporarily prohibit vehicular parking or traffic upon any public street at such times as the Public Works Department is performing maintenance or making improvements to such streets or at such times that a public safety emergency exists on or near such streets.

  2.                K.  Violations. A violation of this subdivision shall constitute a petty

                            Subd 2. HANDICAPPED PARKING.

     

                                        A. No person shall park a motor vehicle in a parking space designated and reserved for the physically handicapped, on either private or public property, unless;

     

  1.                                     B.  That person is physically handicapped in a manner rendering it difficult and burdensome for such person to walk or such person was operating the vehicle under the direction of such a physically handicapped person, and

               

  2.                                      C.  The vehicle visibly bears or contains the certificate or insignia issued to physically handicapped persons by the Minnesota Department of Public Safety pursuant to Minnesota Statute 169.345, subd. 2.

     

                                        B. Notice of such designation of handicapped parking spaces shall be given by the posting of signs designated in accordance with the requirements of the Manual of the Commissioner of Public Safety on Uniform Traffic Control Devices and the location, number and method of signing of such spaces is first approved by the Chief of Police.

     

                                        C. A violation of this Subdivision shall constitute a petty misdemeanor. Vehicles    in violation may be removed, impounded, and kept in custody under the

                                             direction of the Chief of Police.

     

                            Subd 3. RULES ON PRIVATE PARKING LOTS.

     

    On any private parking lots within the City, the following rules shall apply:

     

  1. The police department of the City may post signs at any entrances to such lots

    from public streets to designate one-way traffic for entrance or exit, and drivers of vehicles entering or leaving such lots shall comply with said posted signs.

     

  2. No person shall operate a motor vehicle on such lot at a speed greater than is

    safe and reasonable under existing conditions and in no event at a speed greater than 15 miles per hour.

     

  3. No motor vehicle shall be parked in such lot except in a stall or position which

    is designated by sign or on the surface of the parking area.

     

  4. No motor vehicle shall be parked or allowed to stand in such lot in any area

    which is designated or used for moving traffic.

     

  5. No motor vehicle shall be parked or allowed to stand in such lot at a curb which

    is painted yellow.

     

  6. No motor vehicle shall be parked or allowed to stand in such lot in front of any

    entrance to any business open to public patronage. 

  7. A violation of this subdivision shall constitute a misdemeanor.

     

                            Subd 4. MINNESOTA STATUES, CHAPTER 169, INCORPORATED BY REFERENCE. 

    The regulatory provisions and definitions of the Minnesota Traffic Code found in Minnesota Statutes 1982, Chapter 169, as amended by future Minnesota Law, are hereby adopted as a section regulating the use of highways, streets, alleys and other portions of the City and are hereby incorporated in and made a part of this section by reference.

     

                            Subd 5. FINES. The City Council, upon recommendation of the Police Commission shall establish the fine and rate schedule for all City ordinance parking violations by resolution, and shall periodically review the fine and rates and if it is deemed necessary, adjust them accordingly. All fines shall be paid to the City within seven (7) days of issuance of the parking citation. If a fine is not paid within the seven (7) day period, an administrative fee of fifty percent (50%) of the base fine will be added to the fine, and the parking citation shall be forwarded to the City Attorney's office for prosecution.
