Section 7.40

 Subd 1.  DEFINITION.  For the purpose of this section the term "bicycle" includes any device propelled by human power upon which any person may ride, or any device generally recognized as a bicycle though equipped with two front or two rear wheels. 

 

Subd 2.  RULES OF OPERATION.  Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by state law and the Traffic Section of this City Code. 

 

Subd 3.  A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached thereto. 

 

Subd 4.  No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. 

 

Subd 5.  No person riding upon any bicycle shall attach it or himself to any vehicle upon a roadway. 

 

Subd 6.  Every person operating a bicycle upon a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one that is proceeding in the same direction. 

 

Subd 7.  Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or roadways set aside for the exclusive use of bicycles. 

 

Subd 8.  Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway. 

 

Subd 9.  No person shall ride or park a bicycle upon a sidewalk within the business district.  Whenever any person is riding a bicycle upon a sidewalk other than the business district, such person shall yield the right of way to any pedestrian and shall give audible signal before overtaking and passing pedestrian. 

 

Subd 10.  No person operating a bicycle shall carry any package, bundle, or article which prevents the driver from keeping at least one hand upon the handle bars. 

 

Subd 11.  EQUIPMENT.

 

1.   Every bicycle when in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front and with a red reflector on the rear of a type approved by the Commissioner of Highways which is visible from all distances from 50 feet to 300 feet to the rear when directly in front of lawful upperbeams of head lamps on a motor vehicle.  A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to the red reflector.
2.   Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheels skid on dry, level, clean pavement, and must have a suitable and proper handle bar.

 

 

Subd 12.  USING BICYCLE WITHOUT OWNER'S PERMISSION.  No person shall use another's bicycle without consent of the owner of said bicycle.  

 

Subd 13.  PARENT'S RESPONSIBILITY.  It is unlawful for the parents of any minor child and the guardian of any ward to authorize or knowingly permit his child or ward to violate any provision of this Section. 

                       

Subd 14.  PENALTY.

 

1.   It is a petty misdemeanor for any person to violate any provision of this Section.  A violation may, when applicable, be referred to Juvenile Court.

 2.  The Chief of Police may operate and maintain a violations school for person or persons found violating any of the provisions of this Section.
