Section 10.34

Subd 1.  The following portion of a street in the Second Railway Addition to the City of Tracy, Minnesota is platted, but never been improved and opened for traffic, within the City of Tracy, County of Lyon, Minnesota, to-wit:

All that part of Twelfth Street as shown of the Plat of Second Railway Addition in the City of Tracy as filed and recorded in the office of the County Recorder, in and for Lyon County, Minnesota, bounded as follows:  on the northeast by the southeasterly line of Craig Avenue (Highway 14); on the southeast by the northwesterly line of Block 43 and 44 of said Second Railway Addition; on the southwest by the northeasterly line of South Street; and on the northwest by the Southeasterly line of Block 45 and 46 of said Second Railway Addition.                      


Subd 2.  Notice of public hearing having been published in the Tracy Headlight-Herald, official newspaper of said City, and an opportunity for interested persons to be heard given, it is found and declared that no substantial public interest will be served by continuing said street and that vacation thereof would be beneficial to the public interest.  A petition for vacation of said street has been submitted by all abutting property owners, and all other requirements provided by law for vacation thereof have been met.  

Subd 3.  Pursuant to Minnesota Statutes 160.29, the vacation of said public way shall not affect existing easements therein, nor the authority of any person, corporation or municipality owning or controlling the utilities thereon or thereunder, or to continue maintaining the same or entering upon such public way hereby vacated to maintain, repair, replace, remove or otherwise attend thereto.  Subject to this described reservation of easement, the street described hereinabove is hereby vacated, and a notice of completion of vacation proceedings shall be filed with the Lyon County Recorder
