Section 9.12
Subd 1. AIRPORT BOARD. There is hereby created a Board to be known as the "Airport Board," which consists of three members who shall be legal voters of the City of Tracy. All such members shall serve without compensation. All appointments shall be made by the Mayor of the City of Tracy and approved by a majority of the City Council. At the expiration of the term of any member or members of such Board the Mayor shall appoint or reappoint successors to such vacancy or vacancies and which appointments shall be confirmed by majority of the City Council, for a period of three (3) years, at the first regular meeting of the City Council in March of each year. All such members shall hold office until their respective successors are appointed and qualified. A vacancy in the office of any member shall be filed in the same manner as the original appointment, but only for the unexpired term. All members shall file their acceptance with City Clerk within five (5) days after the notice of their appointment from the City Clerk.
Subd 2. MEETINGS AND OFFICERS. The Airport Board at its first regular meeting on the first Monday in April of each year shall elect from its members a President, Vice-President, and Secretary and Treasurer; but one person shall hold the office of Secretary and Treasurer. The President shall preside at all meetings of the Board and in case of his absence the Vice-President will preside. The President and Secretary shall sign all contracts, orders and other documents to be executed in behalf of the Board. In the absence of the President from the City or in case of his disability for any reason to discharge his duties, the Vice-President shall during such time exercise all of the powers of the President. The President, Vice-President and Secretary-Treasurer shall have such other duties as the Board may prescribe and shall hold their offices during the term of their appointment. Vacancies in the office of President, Vice-President, and Secretary-Treasurer shall be filed in the same manner as the original appointment, but only for the unexpired term.
Subd 3. POWERS. The Board shall have charge of the administration, maintenance, and control of all airports now or hereafter owned by the City of Tracy. The Board shall have such additional powers, duties, and responsibilities, as shall by resolution of the City Council, from time to time, be granted to the Board. To establish rules relating to its own procedure and to the administration, maintenance and control of such airports. Nothing in this Section shall be construed to vest any power in the Board to construct any additional airports or additions to the airport, or appurtenant structures; such powers to be in the City Council. The Board, however, shall from time to time confer with the City Council on all matters of legislative or administrative character. The Board shall keep records of its own proceedings. Reports are to be made semi-annually to the City Council of the City of Tracy at their regular meetings to be held on the second Tuesday in August and February of each year. The Board shall have power to hire and discharge a Manager for said airport, subject, however, to the approval of the City Council.
Subd 4. DISBURSEMENTS. All disbursements authorized to be made by the Board shall be submitted to the City Council for approval and payment.
Subd 5. REMOVAL OF MEMBERS. Whenever two-thirds of the City Council deem it for the best interests of such airport and its affairs it may remove any member of the Board.
Subd 6. LEVY. The City Council shall make an annual levy for the Municipal Airport funds in such amounts as it deems advisable, and the same shall be included in the annual budget of the City of Tracy.
