Section 9.30

Subd 1. There is hereby established a volunteer fire department in the City of Tracy, Minnesota, consisting of a Chief, an Assistant Chief, and Fire Marshal with a minimum force of ten and maximum force of forty firefighters.

Subd 2. SELECTION. The Chief of the Fire Department and the Assistant Chief shall be elected annually by the members of the Tracy Fire Department with recommendation of appointment to the Mayor subject to confirmation by the City Council.

Subd 3. DUTIES OF THE FIRE MARSHAL. The office of Fire Marshal may be held by the Chief or by the Assistant Chief, or any member of the Tracy Fire Department if the Chief so appoints and the City Council by resolution approves. Such appointments shall be approved by the City Council in January of each year. The Fire Marshal shall be charged with the enforcement of all Sections of the City Code aimed at fire prevention. He shall have full authority to inspect all premises and to cause the removal or abatement of all fire hazards.

Subd 4. DUTIES OF THE CHIEF. The Chief shall have control of all fire fighting apparatus and shall be solely responsible for its care and condition. He shall make a semi-annual report to the City Council in March and September on the condition of equipment and needs to the Fire Department. He may submit additional reports and recommendations at any meeting of the City Council. He shall be responsible for the proper training and discipline of the members of the Fire Department.

Subd 5. RECORDS. The Chief shall keep in convenient form a complete record of all fires. Such a record shall include the time of the alarm, location of fire, cause of fire (if known), type of building, name of owner and tenant, purpose for which occupied, value of building and contents, members of the department responding to the alarm, and such other information as he may deem advisable or as may be required from time to time by the City Council or state insurance department.

Subd 6. ASSISTANT CHIEF. In the absence or disability of the Chief, the Assistant Chief shall perform all the functions and exercise all of the authority of the Chief.

Subd 7. RELIEF ASSOCIATION AND FIRE DEPARTMENT BY-LAWS. The City of Tracy hereby adopts the By-Laws of the Tracy Fire Department and the By-Laws of the Tracy Fire Department Relief Association and said By-Laws are hereby incorporated by reference.
