Section 9.40

Subd. 1. ESTABLISHMENT OF THE PARK BOARD

The Park Board shall be established as advisory board to the City Council.

Subd. 2. COMPOSITION AND TERMS

  1. Composition: the Park Board shall consist of five members. One members shall be selected from City Council. The remaining four members shall be selected from the public and need not be residents of the city.

  2. Terms: the member from City Council shall be selected annually. The remaining four members shall be selected to four year terms except that the initial formation shall include two members with partial two year terms and two members with full four year terms. Terms shall begin in March of the calendar year.

  3. Removal: Members may be removed by City Council with or without cause by majority vote of the City Council.

    1. Vacancies during the term shall be filled by appointment by the City Council for the unexpired portion of the term.
    2. Every appointed member shall, before exercising any of his or her duties, take an oath and code of conduct that he or she will faithfully discharge the duties of the office.

 

Subd. 3. ORGANIZATION

  1. Officers: At the first regular meeting in January the Park Board shall elect a Chairperson and Vice-Chairperson from among its members.

  2. Meeting: The Park Board may hold at least one meeting each month as needed at the time and place as they choose. Special meetings may be called at any time by the Chairperson, or in the case of the Chairperson's absence, by the Vice-Chairperson, or as directed by the City Council.

  3. Form and Rules of Order: The Park Board shall adopt rules of order or bylaws for the transaction of business, ordering meetings, and any other business of the Board.

  4. Minutes. Minutes shall be taken for all meetings by the City Administrator or his or her designee.   The Park Board shall approve the minutes at their next regular meeting and then submitted to the Council for their approval.

 

Subd. 4. ATTENDANCE

Members of the Park Board shall be required to attend regular meetings with no more than three consecutive unexcused absences within a calendar year. More than three consecutive unexcused absences may be considered as formal notice of resignation from the Park Board.

Subd. 5. STAFF FOR THE BOARD

The City Administrator shall be a non-voting ex officio member of the board and provide staff support as requested by the Park Board.

Subd. 6. DUTIES

As an advisory body the Park Board shall offer recommendations to City Council regarding the park system including community parks, campgrounds, bike and pedestrian trails, recreational activities, and the aquatics center. This shall include but not be limited to capital expenditures, programming and activities, and maintenance. The Park Board may also engage in private fundraising activities, recommend the disposal and acquisition of real property in the park system, and encourage community engagement in the park system.

Subd 7. EFFECTIVE DATE

This ordinance becomes effective on the date of its publication, or upon the publication of a summary of the ordinance as provided by M.S. § 412.191, subd. 4, as it may be amended from time to time, which meets the requirements of M.S. § 331A.01, subd. 10, as it may be amended from time to time.
