Section 9.18
Subd 1. CREATION. There is hereby created a Cable Commission composed of five (5) members, who shall be appointed by the Mayor with the approval of a majority of the City Council to be known as the Tracy Cable Commission.
Subd 2. TERM OF OFFICE. When first appointed, one (1) Commissioner shall be appointed for one year, who shall be Chairman of the Commission, two (2) for two years, and two (2) for three years. Each Commissioner shall hold his office until his successor is duly appointed and qualified. There shall thereafter be one (1) member of the Commission appointed in 1986 for a term of three years and two (2) Commissioners appointed in 1987 for a term of three years. In 1988 and thereafter, Commissioners shall be appointed for a term of three years upon expiration of each Commissioner's term. Each Commissioner, before entering upon his duties shall subscribe and file with the City Administrator an Oath for the faithful discharge of his duties.
Subd 3. CITY ADMINISTRATOR. The City Administrator shall serve as an advisory member to the Cable Commission, shall make reports of the Cable Commission's action to the City Council and perform other duties consistent with the Charter provisions and duly adopted Section of the City Code.
Subd 4. ORGANIZATION. The Commission shall meet immediately after its appointment and thereafter on a monthly basis. The Commission shall also from time to time affix the times of its meetings and adopt, amend and alter rules for its procedure.
Subd 5. EXPENSES. The Council shall pay from the General Fund all necessary expenses incurred by the Commission in the performance of its duties.
Subd 6. DUTIES. Upon appointment and organization of the Commission, it shall proceed as follows:
A. Act as a primary liaison and coordinator between the cable franchisee and the City Council.
B. Monitor cable television reception on a daily basis with documentation as to date, time and individual channel reception.
C. Receive subscriber complaints and make in person verification.
D. Hold public hearings on matters relating to the franchise, including subscriber complaints, rate changes, services and any other cable related matters.
E. Review with franchisee proposed new services and make recommendations to the City Council.
F. Research needed information including matters during rate change requests, conduct surveys regarding services, quality of services and desired services, evaluate community needs and franchisee's ability to meet those needs.
G. Review proposed policy and rule-making on cable, state and federal, and soliciting and filing public comment thereon and making recommendations to the City Council.
H. Educate community as to potential services of cable communications, including promotion of productions for access channels, and to inform the public and City Council as to requirement for effective and efficient cable operations.
I. Make recommendations to the Mayor and City Council on all other cable matters coming to its attention and performing all other duties and functions which may be assigned to it from time to time.
J. Meet bi-monthly with the franchisee's representative to review any complaints received by the Commission and the franchisee and any other matter then relevant to the operation of the system.
K. Submit minutes of the monthly meetings of the Commission, bi-monthly meetings of the Commission and franchisee and any other hearings held by said Commission to the City Council by the next Council meeting then following such meeting and /or hearing.
L. Submit an annual report to the City Council, including but not limited to, a summary of franchisee's performance, a summary of the utilization of access channels, a review of any plans submitted during the year by the franchisee for the development of new functions, a summary report of Commission deliberations and assigned functions, and a report with respect to the adequacy of system performance and quality of service. If inadequacies are found, Commission shall recommend to the City Council appropriate steps to correct the inadequacies.
Subd 7. AUTHORITY. The City Council retains full and final authority relating to all matters concerning the cable systems and all matters resolved by the Commission shall be subject to review and approval of the City Council.
