SECTION 3.105

 

                        A. That pursuant to published notice, a public hearing was held before the Planning Commission for a proposed rezoning from a B-1 zone (Secondary Business District) to an I-1 (Limited Industrial District) zone relating to the following described property:                    

Lots Eight (8) through Fourteen (14) in Block Forty-Two (42), Lots One (1) through Eleven (11) in Block Forty-three (43), Lots One (1) through Five (5) in Block Forty-six (46) and all of Block Forty-one (41), all of Block Forty-four (44) and all of Block Forty-five (45), all located in the subdivision entitled Block 26 to 46 of the Second Railway Addition in the City of Tracy, as filed and recorded in the office of the County Recorder in and for Lyon County, Minnesota

and more generally described as: Commencing at the westerly corner of Lot Five (5) in Block Forty-six (46) in a easterly direction along and adjacent to South Street to a line between Lots Seven (7) and Eight (8) in Block Forty-two (42); thence northerly between Lots Seven (7) through One (1) and Lots Eight (8) through Fourteen (14) in Block Forty-two (42); thence easterly 165 feet along and adjacent to Lot One (1) in Block Forty-two (42) to the corner of Tenth and Morgan Streets; thence northerly along and adjacent to Tenth Street to Craig Avenue (Highway 14); thence westerly along and adjacent to Craig Avenue until terminating at the westerly corner of Lot Five (5) in Block Forty-six (46), the point of beginning, all located in the subdivision entitled Block 26 to 46 of the Second Railway Addition in the City of Tracy, as filed and recorded in the office of the County Recorder in and for Lyon County, Minnesota. 

                      B. That the findings and recommendations of the Planning Commission filed with the City Council concluded the proposed rezoning amendment from a B-1 (Secondary Business District) to an I-1 (Limited Industrial District) will not materially affect adversely the health or safety of persons residing or working in the neighborhood of the property of the applicant and will not be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood.

 

                        C. That the Tracy City Council unanimously accepted the findings and recommendations of the Planning Commission and adopted the following amendment:  

            The Zoning Map of the City of Tracy is amended as follows: 

            Lots Eight (8) through Fourteen (14) in Block Forty-two (42), Lots One (1) through Eleven (11) in Block Forty-three (43), Lots One (1) through Five (5) in Block Forty-six (46) and all of Block Forty-one (41), all of Block Forty-four (44) and all of Block Forty-five (45), all located in the subdivision entitled Block 26 to 46 of the Second Railway Addition in the City of Tracy, as filed and recorded in the office of the County Recorder in and for Lyon County, Minnesota

 

and more generally described as: Commencing at the westerly corner of Lot Five (5) in Block Forty-six (46) in a easterly direction along and adjacent to South Street to a line between Lots Seven (7) and Eight (8) in Block Forty-two (42); thence northerly between Lots Seven (7) through One (1) and Lots Eight (8) through Fourteen (14) in Block Forty-two (42); thence easterly 165 feet along and adjacent to Lot One (1) in Block Forty-two (42) to the corner of Tenth and Morgan Streets; thence northerly along and adjacent to Tenth Street to Craig Avenue (Highway 14); thence westerly along and adjacent to Craig Avenue until terminating at the westerly corner of Lot Five (5) in Block Forty-six (46), the point of beginning, all located in the subdivision entitled Block 26 to 46 of the Second Railway Addition in the City of Tracy, as filed and recorded in the office of the County Recorder in and for Lyon County, Minnesota shall be rezoned from B-1 (Secondary Business District) to an I-1 (Limited Industrial District).
