SECTION 3.107

Subd. 1 That pursuant to published notice, a public hearing was held before the Planning Commission for a proposed rezoning from a CBD (Central Business District) to an R-1 District (One and Two Family Dwellings), relating to the following described property:

Lots Thirteen (13) through Twenty-Two (22) in Block Five (5) of the Original Plat to the City of Tracy, as filed and recorded in the Office of the County Recorder in and for Lyon County, Minnesota and more generally described as: commencing at the northeast corner of Lot Twenty-Two (22), Block Five (5), Original Plat to the City of Tracy, Minnesota; thence in a southerly direction along and adjacent to Second Street to a line between Lots Thirteen(13)and Twelve (12)in Block Five (5); thence westerly between Lots Thirteen (13) and Twelve (12) to the imaginary center line of the platted alley in Block Five (5); thence northerly along the imaginary center line of said platted alley to the north line of Lot Twenty-Two (22) in Block Five (5); thence easterly along the north line of said Lot Twenty-Two (22) to the Point of Beginning. 

                        Subd. 2. That the findings and recommendations of the Planning Commission filed with the City Council concluded the proposed rezoning amendment from a CBD (Central Business District) to an R-1 (One and Two Family Dwellings) will not materially affect adversely the health or safety of persons residing or working in the neighborhood of the property of the applicant and will not be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood. 

                      Subd. 3. That the City Council unanimously accepted the findings and recommendation of the Planning Commission and adopts the following amendment: 

                        The Zoning Map of the City of Tracy is amended as follows:

Lots Thirteen (13) through Twenty-Two (22) in Block Five (5) of the Original Plat to the City of Tracy, as filed and recorded in the Office of the County Recorder in and for Lyon County, Minnesota and more generally described as: commencing at the northeast corner of Lot Twenty-Two (22), Block Five (5), Original Plat to the City of Tracy, Minnesota; thence in a southerly direction along and adjacent to Second Street to a line between Lots Thirteen(13)and Twelve (12)in Block Five (5); thence westerly between Lots Thirteen (13) and Twelve (12) to the imaginary center line of the platted alley in Block Five (5); thence northerly along the imaginary center line of said platted alley to the north line of Lot Twenty-Two (22) in Block Five (5); thence easterly along the north line of said Lot Twenty-Two (22) to the Point of Beginning                                

shall be rezoned from B-2 Central Business District to an R-1 One and Two Family Residence District
